Not your employer
Using Contractor creates no employment relationship and no contract of service.
Legal
The agreement between you and the company that operates Contractor, covering what the platform does, what it does not do, and what each side is responsible for.
Using Contractor creates no employment relationship and no contract of service.
Your engagement is with the company or agency. Contractor records it; it does not sign it.
It is built to outlast any single contract, and you can take a copy of it.
These terms are governed by the laws of Kenya.
These terms are an agreement between you and ERP Tohama Ltd, of Britam Towers, 24th Floor, Hospital Road, Upper Hill, P.O. Box 12295-00100, Nairobi, Kenya, the ERP TOHAMA Group company registered in Kenya.
By creating an account or using the site you accept these terms. If you do not accept them, do not use the service.
Contractor is a platform where an independent professional maintains a single professional record: verified identity, professional history, published availability, certifications, and the engagements they have worked. Companies and recruitment agencies can see agreed parts of that record in order to consider you for work.
Contractor sits inside the MyResource platform family. Companies engage through MyResource, recruitment agencies through Recruiter, and you through Contractor. The three see different parts of the same record.
Contractor is not your employer. Using the platform creates no employment relationship between you and the operator, and no contract of service.
Contractor is not a recruitment agency and does not represent you. Where an agency represents you, that relationship is between you and the agency.
Contractor is not a party to the engagement you agree with a company or an agency, and does not guarantee that any engagement will be offered, will start, will continue, or will be paid.
Contractor does not employ, supervise, direct or vet the companies or agencies that use the platform beyond the review described in these terms, and a review is not a guarantee.
You must be at least 18 years old. The service is not offered to children and is not designed for them.
You must have the right to work wherever you propose to perform the work, and you are responsible for holding and maintaining that right. Contractor records the status of an eligibility check; it does not obtain permission on your behalf.
You must give accurate information. The value of the record to you depends on it being true, and a record found to be false may be suspended.
The professional record is yours. It is intended to outlast any single contract, and you can obtain a copy of it or ask for it to be deleted, subject to the retention obligations set out in the Privacy Policy.
You are responsible for your account credentials and for activity under your account. Tell us promptly if you believe your account has been accessed by someone else.
You may hold one account. Multiple accounts for one person defeat the purpose of a verified record.
A verification confirms the specific item checked, at the time it was checked. An identity check confirms identity. A reference check confirms that a named referee said what is recorded. An eligibility check confirms a right-to-work status and its validity.
No verification is a statement about your competence, your conduct, your reliability, or your suitability for any role. Contractor displays what was confirmed and what was only stated, and does not blur the two.
Verifications can expire. A status shown as current is current as at the date displayed alongside it.
Different parties see different parts of your record, and the split is deliberate. The table on the Privacy Policy sets out, item by item, what you see, what an agency recruiter representing you sees, and what a client's manager sees.
Your day rate is visible to you in full. An agency's margin is visible to the agency, not to you and not to the client. Identity documents are never released to a company or an agency; only the status of the check is.
You control which agencies represent you and you can see the representation on your record.
An agency is reviewed before it is admitted to the platform. That review covers the checks described on the Ecosystem pages and is not a guarantee of the agency's conduct, solvency, or commercial terms.
An agency may only represent you for an opportunity where you have agreed to that representation. If you believe you have been represented without agreement, report it and it will be investigated.
Commercial terms between you and an agency, including your rate and the agency's margin, are agreed between you and the agency.
A requirement shown on the platform may be a confirmed vacancy, a planned requirement, or an anonymised market signal. Each is labelled, and a planned requirement is never presented as a confirmed one.
The engagement contract is between you and the company or agency that engages you. Contractor records it; it is not a party to it.
Timesheets submitted and approved through the platform are a record of what was submitted and approved. Payment obligations arise under your engagement contract, not under these terms.
Any rate figure displayed on the site is either drawn from measured platform activity and labelled as such, or a placeholder labelled as a placeholder. Neither is an offer, a quotation, or a prediction of what you will be paid.
The rate calculator is a modelling tool. It does not account for your tax position, your costs, your unbilled time, or your circumstances. It is not financial, tax or accounting advice, and you should take professional advice on your own position.
Contractor does not hold client money, does not pay you, and is not a payment service.
Certification and course information comes from awarding bodies and learning partners and can change. Listing a certification is not an endorsement of the provider or of its commercial terms.
Completing a certification does not guarantee an engagement, a rate, or an interview. Contractor states this on the Certifications pages and states it here.
Assessment, credential issue and renewal remain the responsibility of the awarding body.
The Market Update, Opportunities and International publications describe method and report only what platform activity supports. Where data is insufficient they say so rather than estimating.
Nothing in those publications is advice about your career, your rate, or your decisions, and you should not rely on it as the sole basis for either.
Figures may be revised as more data arrives, and a revision will be identified as one.
Do not misrepresent your identity, your experience, your qualifications, your availability, or your right to work.
Do not use the platform to harass, discriminate against, or abuse any other user.
Do not extract, scrape, or resell data about other users. The platform is not a database to export.
Do not attempt to interfere with the security or operation of the service.
The Contractor Code of Conduct forms part of these terms. Under it, you provide accurate professional information, respect client confidentiality, keep honest timesheets, fulfil the professional commitments you agree to, and communicate respectfully with companies and recruiters.
Fraud, misrepresentation, harassment, unauthorised sharing of personal information and misuse of the platform are prohibited. Breaking these rules may lead to restrictions on your account or its suspension, subject to applicable law.
You keep ownership of the content you provide. You grant the operator the licence it needs to host, display and share that content with the parties described in the Privacy Policy, for the purpose of running the service.
The platform itself, its software, its design and its publications remain the property of the operator or its licensors.
Your account may be suspended or closed where these terms are breached, where information is found to be false, or where the law requires it. Where the circumstances allow, you will be told why.
You may close your account at any time. Closure and deletion are not the same thing: your profile data is deleted or anonymised within 90 days of closure, while contracts, invoices and financial records are kept for the periods that accounting, tax and other law require. The Privacy Policy sets this out in full.
The service is provided as it is. There is no promise that it will be uninterrupted, error free, or continuously available, and features may change.
The platform is not live at the date of this draft, and several parts of the site describe how it will work rather than how it currently works. Those parts are labelled.
ERP Tohama Ltd operates Contractor as a professional engagement and career-management platform. Contractors and companies remain responsible for their own contractual obligations to each other.
The platform does not guarantee employment, project availability, payment by a third party, or any particular professional outcome, and is not liable for the performance of engagement contracts it is not a party to.
These terms may change. Material changes will be notified before they take effect, and the version and date will be shown at the top of this page.
Continuing to use the service after a change takes effect means you accept the changed terms.
These terms are governed by the laws of the Republic of Kenya.
Subject to any mandatory legal rights you hold and to any dispute-resolution provision agreed between us, disputes are submitted to the courts of competent jurisdiction in Kenya.
Nothing agreed here removes any right you have under Kenyan consumer or data protection law.
